IF YOU ARE UNDER THE CARE OF A PHYSICIAN, HAVE RECENTLY BEEN UNDER THE CARE OF A PHYSICIAN, OR HAVE EXPERIENCED ANY SIGNIFICANT MEDICAL PROBLEMS, THIS INFORMATION SHOULD BE DISCLOSED AND CLEARANCE FROM YOUR PHYSICIAN SHOULD BE OBTAINED. IF YOU HAVE NOT UNDERGONE A PHYSICAL EXAMINATION, IT IS RECOMMENDED THAT YOU DO SO BEFORE BEGINNING AN EXERCISE PROGRAM.

I agree to abide by any rules that are adopted by Glaidator Fitness, LLC (Gladiator Fitness"). I understand that Gladiator Fitness management reserves the right to terminate any membership with or without cause or notice, for any reason at any time. I hereby acknowledge that all information provided by me is accurate and that I have read and understand the preceding prior to signing and agree to all terms outlined herein.

The exercise and activity opportunities offered through the facilities of Gladiator Fitness allow a person to engage in various exercise and/or physical activities potentially beneficial to one's health and well-being. However, I recognize and understand that there are inherent risks of various physical and mental conditions, illnesses, and/or injuries associated with (a) engaging in any exercise or physical activity, (b) the use of equipment at Gladiator Fitness, and/or (c) the use of Gladiator Fitness' facilities. Such risks include any and all types of physical injuries, physical and mental conditions and/or illnesses including, but not limited to, sprains, strains, broken bones, concussions, lacerations, abnormal blood pressure, heartbeat disorders, fainting, shortness of breath, chest pain, strokes, heart attack, or even death.

I further recognize and understand that any and all such risks are compounded in that many of the exercise and/or physical activity opportunities of Gladiator Fitness are unsupervised, including, but not limited to, use of its gym and/or all types of exercise equipment, and/or use of its locker rooms, dressing rooms, shower and/or sauna room. I hereby agree and consent to voluntarily engage in any and all exercises and physical activity opportunities, supervised or unsupervised, at Gladiator Fitness, to voluntarily use Gladiator Fitness' exercise equipment, and to voluntarily use Gladiator Fitness' facilities at my own risk and with full knowledge and appreciation of any and all dangers and risks inherent therein.

1 acknowledge that I have and am hereby advised to seek and obtain any necessary medical clearances from my physician and to undertake a physical examination prior to beginning any exercise activity. I hereby assume full responsibility for any and all risks of any bodily injury, illness, death and/or property damage suffered by me.

In consideration of Gladiator Fitness granting me (or any dependent of mine) the privilege of participating in health and fitness activities, I hereby release, waive, hold harmless, forever discharge and covenant not to sue Gladiator Fitness, its officers, members, agents, servants, and/or employees for any and all costs, liability, claims, causes of action, loss or damage, injury, claims of demands of any type, whether known or unknown, on account of or in any way related to any illness, condition, and/or injury to my person or property, or which may result in my death as a result of engaging in any exercise and activity opportunities at Gladiator Fitness, any use of Gladiator Fitness' exercise equipment, and/or any use of Gladiator Fitness' facilities.

I hereby agree to idemnify and hold harmless Gladiator Fitness' officers, members, agents, servants, and/or employees from any and all costs, liability, claims, causes of action, loss or dmage, injury, claims of demands of any type by any third parties in connection with my membership at Gladiator Fitness. Such indemnity shall include all legal costs including fees and disbursements) incurred.

This agreement supersedes any and all oral or written agreements between Gladiator Fitness and me. I acknowledge that no representations, inducements, promises, or agreements of any kind have been made by anyone acting on behalf of Gladiator Fitness, other than those representations that are embodied herein. No other agreement, statement, or promise is valid, binding, or enforceable unless it is contained in this agreement. I further agree that this agreement shall be binding upon my heirs and assigns and that my membership at Gladiator Fitness may not be assigned by me without the written permission of Gladiator Fitness.

My signature below acknowledges that I have reviewed and received a fully completed and executed copy of this agreement and a copy of the Member Policies and Procedures. I further understand that the Member Policies and Procedures may be modified by Gladiator Fitness at any time at its sole discretion with or without advance notice to me.

This agreement remains in effect and will be automatically renewed upon the expiration of the membership option I have selected (at the prevailing membership rates at the time) unless / cancel my membership in writing within the earlier of ten (10) days prior to the automatic renewal date or within ten (10) days of when I have used my last session.

I am the parent or legal guardian of the minor participant named above. I have read this document and agree to its terms on behalf of myself and the minor, releasing Gladiator Fitness from all liability and agreeing to indemnify them for any claims
